The importance of record-keeping for psychotherapists cannot be overemphasized. An adequate record is required by ethics codes, professional regulations and insurers and is essential formalpractice and disciplinary defense and insurance reviews. The core of an adequate record is a treatment plan and progress notes. Also recommended are intake documentation, psychotherapy notes as defined by HIPAA in certain instances, records of consultation and supervision, and termination summaries. This course will (i) review clinical and legal recommendations for the types and contents of records, including with templates of basic record-keeping forms, and (ii) address standards required by insurers to justify the medical necessity of psychotherapeutic care, and (ii) examine factors leading to denial of medical necessity and audits by payors.
Bruce V. Hillowe, JD, PhD is a mental healthcare attorney with a law practice in Mineola, New York. A graduate of Binghamton University, Duke University School of Law, and Adelphi University Derner Institute (Clinical Psychology and Postdoctoral Programs), he formerly practiced as a psychologist-psychoanalyst, including as a coordinator of clinical training and director of a forensic mental health service. He was a teaching attending psychologist in law and ethics at a major teaching hospital for 15 years. He currently teaches courses in ethics and law as adjunct faculty at the Derner Institute. He is legal counsel to numerous mental health facilities, institutes, and practitioners and sponsors legal plans for professional associations. He has written articles and book chapters including for law reviews and healthcare publications, most recently regarding scope of practice and disciplinary defense. He is listed in the Bar Register of Preeminent Lawyers in healthcare law and is a “Super Lawyer” featured in the New York Times Magazine.
Learning Objectives:
At the conclusion of this program participants will be able to:
- Explain current sources of standards for record-keeping by psychotherapists
- Plan and prepare the basic contents of records for psychotherapy
- Identify necessary and problematic elements of a treatment plan and progress note
- Analyze the differences between progress notes and psychotherapy notes
- Apply risk management principles to record-keeping.
- Identify information sought by payors in determining medical necessity, and elements that may lead to a denial of medical necessity or audits

CE credits are granted to participants with documented attendance of the entire program and completed online evaluation form. No partial credits will be offered. It is the responsibility of the participants seeking CE credits to comply with these requirements. Upon completion of this program and online evaluation form, participants will be granted 2 CE credits.
