Jonathan D. Rubin’s presentation will provide an overview of the many malpractice litigation risks faced by psychiatrists, psychologists, psychoanalysts/therapists and social workers in New York State. He will also discuss some of the tools and protections available to mental healthcare providers to help reduce the risk of litigation and to mitigate liability. This workshop will provide an overview of malpractice claims against mental health providers, highlight common risks in the practice, and outline means to protect providers and their practice. Topics will include record keeping, confidentiality and privilege, the duty to protect third parties from a dangerous patient, terminating treatment of a patient, informed consent, and improper relationships with a client.
Learning objectives:
This workshop is designed to help attendees understand: 1) the different kinds of malpractice litigation risks to mental health providers, 2) what some of the most important best practices for avoiding liability are, and 3) the tools and protections available to help reduce the risk of litigation.
Based on the content of this workshop, the attendee will be able to:
· Identify at least three of the most common sources of litigation;
· Explain the importance of accurate and thorough record keeping;
· Describe their obligation to report a threat of serious and imminent danger to a patient or third person;
· Understand the issues that should be considered in the termination and abandonment of a client;
· Assess and analysis risk management issues related to possible boundary violations;
· Understand social media risks and issues in communicating with and about patients and other emerging and
evolving technological issues and modes of communication.
Jonathan D. Rubin, J.D. is a senior partner with Kaufman, Borgeest & Ryan LLP in New York City. His practice areas include Medical Malpractice Defense, Long Term Care and Nursing Home Defense, Health Care, Products Liability Defense and General Liability Defense Litigation. Mr. Rubin represents hospitals, nursing homes, physicians and health care professionals in civil litigation matters in state and federal courts. Mr. Rubin has given numerous presentations on topics including the litigation of complex medical malpractice matters and a variety of risk management issues for a wide variety of health professionals. Mr. Rubin also has particular expertise in the defense of mental health providers and has lectured extensively in this area including recent ASHRM lectures focusing on “Managing Psychiatric Patients in Acute Care Settings” as well as lectures before they NY State Chapter of the American Psychology Association, NASW and many other local psychoanalytic and psychotherapy groups and organizations.

The New York State Education Department has approved this workshop for 3 contact hours (CEUs) for LMSWs, LCSWs, LMHCs and LPs. A certificate will be emailed upon request to those who sign the attendance sheet at the end of the workshop, complete an evaluation and pay an administrative fee of $15. There is no charge for those affiliated with MITPP, MCMH or MSPP.

MITPP, chartered by the New York State Board of Regents, offers three certificate programs: a three year program in Psychoanalytic Psychotherapy with Adults, a two year program in Child and Adolescent Psychotherapy, and a program leading to the New York State license in Psychoanalysis. Social Workers may qualify for the LCSW through their training at MITPP. Matriculants see patients at the Metropolitan Center for Mental Health, which is licensed by the Office of Mental Health. Truly affordable training: Low tuition of $1,200 per semester includes both individual and group supervision and up to three courses. Courses are also offered on a non-matriculated basis.
The application deadline for the Spring 2018 semester is January 16, 2018.
